  1’st。thattheyshallnotbysuchtreatyrestrainthelegislaturesofthestatesfromimposingsuchdutiesonforeignersastheirownpeoplearesubjectto。2’dly。norfromprohibitingtheexportationorimportationofanyparticularspeciesofgoods。Leavingthesetwopointsfree,Congressmaybytreatyestablishanysystemofcommercetheyplease。But,asIbeforeobserved,itisbytreatyalonetheycandoit。Thoughtheymayexercisetheirotherpowersbyresolutionorordinance,thoseovercommercecanonlybeexercisedbyformingatreaty,andthisprobablybyanaccidentalwordingofourConfederation。IfthereforeitisbetterforthestatesthatCongressshouldregulatetheircommerce,itisproperthattheyshouldformtreatieswithallnationswithwhomwemaypossiblytrade。Youseethatmyprimaryobjectintheformationoftreatiesistotakethecommerceofthestatesoutofthehandsofthestates,andtoplaceitunderthesuperintendenceofCongress,sofarastheimperfectprovisionsofourconstitutionwilladmit,anduntilthestatesshallbynewcompactmakethemmoreperfect。Iwouldsaythentoeverynationonearth,_bytreaty_,yourpeopleshalltradefreelywithus,&ourswithyou,payingnomorethanthemostfavourednation,inordertoputanendtotherightofindividualstatesactingbyfitsandstartstointerruptourcommerceortoembroiluswithanynation。Astothetermsofthesetreaties,thequestionbecomesmoredifficult。Iwillmentionthreedifferentplans。1。
