Ihavedividedmyanalysisoftheconditionofthefeudalpeasantryintotwopartsaccordingtoaprincipleforciblysuggested,asIthink,bythematerialathand。TherecordsoftrialsintheKing’sCourt,andthedoctrinesoflawyersbasedonthem,cannotbetreatedinthesamewayasthesurveyscompiledfortheuseofmanorialadministration。Thereisamarkeddifferencebetweenthetwosetsofdocumentsastomethodandpointofview。Inthecaseoflegalrecordsamethodofdialecticexaminationcouldbefollowed。Legalrulesarealwaysmoreorlessconnectedbetweenthemselves,andtheinvestigatorhastofindout,first,fromtheapplicationofwhatprinciplestheyflow,andtofindout,secondly,whetherfundamentalcontradictionsdiscloseafusionofheterogeneouselements。Thestudyofmanorialdocumentshadtoproceedbywayofclassification,toestablishinwhatbroadclassesthelocalvariationsoftermsandnotionsarrangethemselves,andwhatvariationsofdailylifethesegroupsorclassesrepresent。
