ItmaywellbeaskedwhythedestructiveeffectsofNormanvictorywerearrestedonancientdemesnesoil?Wasnotthekingaslikelytoexercisehisdiscretioninrespectofthepeasantryasanyfeudallord,andisitlikelythathewouldhavelethimselfbefetteredbyconsiderationsandobligationswhichdidnotbindhissubjects?Inviewofsuchquestionsoneistemptedtotreattheprotectionofthetenantsontheancientdemesnemerelyasapeculiarboongrantedtothepeoplewhomthekinghadtogiveaway。Ineednotsaythatsuchaninterpretationwouldbeentirelywrong。IhopeIhavebeenabletomakeoutconvincinglythatlegalprotectiongivenagainstprivatelordsonmanorswhichhadbeenalienatedwasonlyanoutgrowthfromthatcertaintyofconditionwhichwasallowedontheking’sownlands。Iwilljustaddnowthatoneverystrikingfactoughttobenoticedinthisconnexion;certaintyoftenureandserviceislimitedtooneparticularclassinthemanor,althoughthatclassisthemostnumerousone。Ifthisprivilegecameintobeingmerelybythefixationofstatusatthetimewhenamanorpassedfromthecrown,thestateofthevillainpurewouldhavegotfixedinthesamewayasthatofthevillainsocman。Butitdidnot,andsoonecannotshirkthedifficultquestion,Whatgaverisetothepeculiarprotectionagainstthelordwhenthelordhappenedtobeking?
Ithinkthatthreeconsiderationsopenthewayoutofthedifficulty。Tobeginwith,thekingwasdecidedlyconsideredastheonegreatsafeguardofSaxontraditionandtheonedefenderagainstNormanencroachments。hehadconstantlytohearthecryabout’thelawsofEdwardtheConfessor,’andalthoughtheclaimmaybeconsideredasaveryvagueoneingeneralmatters,itbecamesubstantiatedinthiscaseoftenureandservicesbytheDomesdayrecord。Thenagain,theproportionoffreeownerswhohadlapsedintoterritorialdependencemusthavebeenmuchgreaterontheking’slandthananywhereelse;itwasquiteusualtodescribeanallodialownerfromthefeudalpointofviewasholdingunderthekinginaparticularway,andvillainsocagewasonlyoneofseveralkindsofsocageafterall。Last,butnotleast,theprotectionagainstexactionswasinrealitydirectednotagainstthekingpersonallybutagainsthisofficers,andthekingpersonallywasquitelikelytobenefitbyitalmostasmuchashismen。Itamountedafterallonlytoarecognitionofdefinitecustomsingeneral,toaspecialjudicialorganisationofthemanorwhichmadeitlessdependentuponthesteward,andtothefacilitiesaffordedforcomplaintandrevisionofjudgments。Astothislastitmustbenotedthattheking’smenwerenaturallyenoughinabetterpositionthantherestoftheEnglishpeasantry;thecurseofvillainagewasthatmanorialcourtswereindependentofsuperiororganisationasfarasthelowertenantswereconcerned。Butcourtsinroyalmanorsweretheking’scourtsafterall,andassuchtheycouldhardlybeseveredfromthehighertribunalsheldintheking’sname。
